Music Licensing for Events in Turkey: Does the Venue's Licence Cover You, and What Does It Cost?

Short answer: yes, you need one. Article 41 of Turkey's Law on Intellectual and Artistic Works (No. 5846, known as FSEK) requires any venue open to the public, whether entry is paid or free, to sign a written contract under Article 52 before works, performances, phonograms and productions are used. Your counterpart is either the rights holder or a collecting society. Music has two separate sides in Turkey: MESAM and MSG on the authors' side, MÜ-YAP and MÜYORBİR on the neighbouring rights side. The expensive surprise is in the second point. The venue's annual music licence does not cover your invitation-only event, and the 2026 MSF tariff repeats the same footnote under each category: ticketed, non-ticketed and invitation-based events are charged separately. In numbers, the 2026 MESAM-MSG tariff sets a daily fee of TRY 42,729.12 for fashion shows, launches, promotions, openings and private parties, while MÜYORBİR's matching category is TRY 16,000 per day. Both figures exclude VAT. Below: where those numbers come from, how the thematic discount works, how ticketed events switch to a percentage, and what to demand in writing.

Why does event music need a licence at all?

FSEK Article 41 obliges venues open to the public, paid entry or not, to sign an Article 52 compliant contract covering the use of works, performances, phonograms, productions and broadcasts. The contract must be written, and each right it covers has to be listed explicitly. Music rights sit in two layers. The first layer is the work itself, the lyrics and the composition, tracked by MESAM and MSG. The second layer is the recording, meaning the neighbouring rights of the phonogram producer and the performing artist, tracked by MÜ-YAP and MÜYORBİR. That is why one song can generate two separate invoices: one goes to whoever wrote it, the other to whoever recorded and performed it. The structure shifted slightly in 2026. MESAM and MSG now publish their public-venue tariffs through MSF, the federation they belong to, for every category except concerts, cultural events, exhibitions, private entertainment and stadiums. So a hotel's annual licence comes from the MSF tariff while your event is still priced from the MESAM-MSG tariff. The category is growing worldwide too. CISAC's Global Collections Report 2025, published on 6 November 2025, put global royalties collected for creators at 13.97 billion euros in 2024, with the live and background category up 9.6 percent and past 3.5 billion euros.

Does the venue's annual licence cover your event?

No. The 2026 MSF tariff carries the same note under every category from restaurants to nightclubs: ticketed, non-ticketed and invitation-based events are billed separately under the relevant category. MÜYORBİR's tariff draws the same line and treats the venue's public-venue contract as one line item, not as an exemption that swallows the event. Here is how it plays out. You rent a hotel ballroom, the hotel shows you its annual licence, and you assume the matter is closed. Weeks after the event, an invoice reaches the organiser or the brand directly. Put one sentence into the venue agreement: who obtains the collecting society permissions for the music played on the day, and whose budget pays for them. If the venue takes it on, get that in writing, because verbal reassurance is worth nothing once the invoice arrives.

What does a one-day corporate event cost in 2026?

Section 4.C of the 2026 MESAM-MSG General Licensing Joint Tariff describes corporate work almost word for word: fashion shows, launches, promotions, openings, events, private entertainment parties and other daily or monthly organisations. The figures are TRY 42,729.12 for a daily event, TRY 85,458.25 per day and per event for organisations running up to a week, and TRY 21,364.56 per day for celebrations, ceremonies and anniversary activities. Section 4.B of the same tariff prices music at exhibitions, fairs, receptions, meetings and galas by floor area: TRY 22,847.30 per day for 0-500 m², TRY 45,694.60 for 501-1000 m², and TRY 4,569.46 for each additional 100 m². The neighbouring rights side is far more modest. MÜYORBİR's 2026 tariff charges TRY 16,000 per day for fashion shows, openings, events and private parties, and in the exhibition, fair, reception, meeting and gala category TRY 5,000 per day for 0-500 m², TRY 10,000 for 501-1000 m², and TRY 800 for each additional 100 m². MÜ-YAP publishes its own annual tariff on behalf of phonogram producers. Three caveats: every figure excludes VAT, tariffs are revised at the start of each year, and the societies decide which category applies to your event. Budget this line by asking, not by guessing, once you know the floor area and the run of show.

Why does a ticketed event switch to a percentage?

Once you sell tickets, the logic changes and a share of gross revenue replaces the flat fee. In the 2026 MESAM-MSG tariff, ticketed concerts and events are charged at 6 percent for live performance, DJ and karaoke, 4 percent for dance shows, musicals, opera, ballet and theatre, 10 percent for online digital events and concerts, and 15 percent for fully interactive streaming concerts. MÜYORBİR's rates for the same items are lower: 1 percent for live performance, 2 percent for DJ and karaoke events. Underneath the percentages sit capacity-based minimums. The 2026 MESAM-MSG list runs from TRY 2,450 for venues of 100 or fewer, TRY 5,250 for 101-250, TRY 14,000 for 251-500, TRY 28,000 for 501-1,000 and TRY 52,500 for 1,001-2,500, up to TRY 252,000 for capacities above 10,000. Complimentary invitations are not treated as free: they are calculated at the lowest ticket price on sale. Check the revenue definition as well. MÜYORBİR defines gross revenue as the total after VAT and levies are deducted, and it includes advertising and sponsorship income. One clause is worth remembering. Under item 16 of the 2026 MESAM-MSG tariff, if you meet your contractual obligations within 30 days of the event date, the minimum guarantee is waived and the licence fee is calculated at 4 percent. Missing that window costs real money.

Does your event qualify as thematic? That is 30 percent off

The tariffs contain a definition most corporate organisers never notice. A thematic event is one where the user focuses on a subject other than music and uses music in a secondary role. Both the MESAM-MSG and the MÜYORBİR 2026 tariffs apply a 30 percent discount to thematic events. Picture a dealer meeting: presentations, panels and product training all day, with music covering stage transitions and the dinner. That profile fits the definition. Turn the evening of the same meeting into a two-hour DJ set and music is no longer secondary. If you plan to claim the discount, keep the paperwork: a minute-by-minute run of show is the clearest evidence of where music plays and for how long. Non-profit schools, associations and foundations may also be granted a discretionary discount, but the MESAM-MSG tariff requires notice at least 15 days before the event. Applications made later are not considered.

Spotify playlists, DJs and cover bands: what triggers what?

The sentence we hear most often at corporate events is "we just play it from Spotify." A personal subscription does not solve this. Spotify's terms of use grant permission for personal, non-commercial use of the service and its content, and other consumer music subscriptions follow the same logic. The second question is which rights are triggered. If you play recorded music, whether from a playlist or a DJ booth, both the authors' side and the neighbouring rights side apply. If a live band on stage performs someone else's song, the author's right still applies, which is why the tariffs list live performance separately. The third option is production libraries, often marketed as royalty free. What matters there is not what the licence promises but what you can prove. Keep a written list with the title, composer, licence number and source of every track used. When a letter arrives from a collecting society, that list is what ends the conversation.

The aftermovie needs its own permission

An event licence covers the communication to the public of music played in the room that day. Publishing your aftermovie on LinkedIn or YouTube is a different use: combining music with picture and reproducing it falls under mechanical and synchronisation rights. MESAM and MSG publish a separate joint mechanical licensing tariff for this, distinct from the general licensing tariff, and the 2026 version is on their sites. The practical consequence is clean: paying for a song played on stage does not give you the right to use the same song in your recap video. Either clear the video separately or pick licensed library music from the start. Corporate communications teams usually discover this after the edit is locked. Choosing the music at brief stage is both cheaper and faster.

What happens if you skip it, and what to demand in writing

Unlicensed use can cost more than the tariff. FSEK Article 68 lets the rights holder demand up to three times the amount that could have been claimed had a contract been signed, or three times the going market rate. On the criminal side, Article 71 provides for one to five years of imprisonment or a judicial fine for anyone who adapts, reproduces, distributes or communicates a work to the public without the rights holder's written permission. These offences are prosecuted on complaint, and the complaint period is six months from the day the offence and the offender become known. Read that as a calendar item rather than a scare story. Six lines belong in your quote and contract: which collecting societies will be contracted; how many days before the event the application will be filed; whether the fee sits with the venue, the organiser or the brand; whether the event will be declared thematic; whether the quoted price includes VAT; and whether the aftermovie and social media use are covered.
